Terms of Service

1. The Service

Krtiv.ai provides digital travel discovery for Maharashtra, including destination guides, curated experiences, maps and galleries, AI-assisted itinerary planning, account dashboards, and related features. Content is provided for informational and travel-planning purposes. Itineraries and recommendations are suggestions only and may require independent verification before you travel.

2. Eligibility and accounts

You must be able to enter a binding contract under applicable Indian law to create an account. You are responsible for the accuracy of information you provide and for keeping your login credentials confidential. You must notify us promptly of any unauthorised use of your account.

You may register using email/password, mobile OTP, Google, or Facebook Login where those options are available. Additional terms of those providers may also apply when you use them to sign in.

3. Acceptable use

You agree not to:

• Misuse the Service, attempt unauthorised access, probe or disrupt systems, or interfere with other users.
• Upload unlawful, harmful, infringing, or misleading content, or misuse AI planning tools to generate abusive or illegal outputs.
• Scrape, copy, or redistribute substantial parts of the Service or content except as allowed by law or with our prior written permission.
• Impersonate any person or entity, or misrepresent your affiliation with Maharashtra Tourism or eFlag Corp.
• Use the Service in violation of applicable laws or third-party rights.

4. Your content and trip data

You retain ownership of content you submit (such as trip preferences, notes, and saved itineraries). You grant us a limited licence to host, process, and display that content as needed to operate the Service for you. You are responsible for ensuring you have the rights to submit any content you provide.

5. AI-assisted features

Some features generate itineraries or travel suggestions using automated systems. Outputs may be incomplete, outdated, or inaccurate. Always confirm timings, access rules, safety conditions, bookings, and transport with official sources before travelling. AI outputs do not constitute professional travel, legal, or safety advice.

6. Third-party services and links

The Service may link to or integrate maps, media, social networks, payment or messaging providers, and destination websites. We are not responsible for third-party content, availability, or practices. Your use of third-party services is subject to their own terms and privacy policies.

7. Intellectual property

The Service, including branding, UI, curated editorial content, and software (excluding your user content and third-party materials), is owned by or licensed to us and protected by intellectual property laws. Maharashtra Tourism marks and government marks belong to their respective owners. You may not use our marks without prior written permission.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that travel information is complete or current.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, PARTNERS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM (IF ANY) OR (B) INR 5,000.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Indemnity

You agree to indemnify and hold harmless eFlag Corp, Maharashtra Tourism partners involved in operating the Service, and their respective officers and agents from claims arising out of your misuse of the Service, your content, or your violation of these Terms or applicable law.

11. Suspension and termination

We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or if we discontinue the Service. You may stop using the Service at any time and may request account deletion as described in our Privacy Policy and User Data Deletion Request page.

12. Governing law

These Terms are governed by the laws of India. Courts in Mumbai, Maharashtra shall have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you.

13. Changes

We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance of the updated Terms. Material changes may be highlighted on the site or via notice where appropriate.
